SMITH PARTY BEE Rental Agreement & Service Terms

This Rental Agreement is between SMITH PARTY BEE (“Provider”) and the person booking the rental (“Customer”).
By reserving, paying a deposit, signing electronically, or accepting delivery/pickup of equipment, the Customer agrees to all terms listed below.

PART 2 — RESERVATION & PAYMENT (FINAL)
1. A $50 refundable security deposit is required to reserve equipment and hold the date.
2. This $50 is not part of the rental price. It is held separately and returned after inspection.
3. The deposit is used to cover damages, missing items, cleaning issues, or late return fees.
4. If the cost of damage or loss exceeds $50, the Customer is responsible for paying the remaining balance of the repair or replacement cost.
5. The rental balance must be paid in full before delivery or pickup.
6. The security deposit is non-refundable if the Customer cancels, but may be transferred one time only to a new date (see Weather Policy).

PART 3 — DELIVERY, PICKUP & SETUP POLICY
1. Delivery is optional and charged separately based on distance.
2. Delivery includes curbside drop-off only, unless setup service is purchased.
3. If the Customer requests full setup, an additional setup fee will apply.
4. The Customer must be present during delivery or pickup to inspect and confirm items.
5. If no one is present and the Provider must wait, a $1 per minute waiting fee may be charged.
6. Pickup by the Customer is available at an agreed location and time.
7. A valid photo ID is required for all customer pickups.
8. Equipment must be secured properly during transport; SMITH PARTY BEE is not responsible for damage that occurs once the Customer takes possession.
9. If items are not ready or accessible at the scheduled pickup time, a late return fee may apply.
10. Delivery fees are non-refundable once items have left the Provider’s possession.

 PART 4 — DAMAGES, MISSING ITEMS & LIABILITY (FINAL)
1. All rental items must be returned in the same condition they were received.
2. The $50 security deposit is held to cover minor damages, cleaning issues, missing pieces, or late returns.
3. If damage, loss, or replacement cost is greater than $50, the Customer is responsible for paying the full remaining balance.
4. Replacement value is based on current retail cost of the item.
5. “Accidental” damage is still considered damage. This includes:
• Writing / markers / crayons
• Food or drink stains
• Heat or candle damage
• Rips, cracks, or structural damage
6. Missing items (including small parts such as straps, cushions, or screws) will be charged at full replacement cost.
7. If items are stolen or not returned, the Customer agrees to pay full replacement value.
8. The Customer is responsible for proper protection of equipment during their event (rain, dirt, pets, etc.).
9. SMITH PARTY BEE is not liable for injuries or accidents resulting from improper use of the equipment.

PART 5 — CLEANING & RETURN CONDITION (FINAL)
1. All items must be returned clean and in good condition.
2. A cleaning fee will only be charged if items are returned dirty, sticky, stained, or with food/drink residue.
3. Cleaning fees are deducted from the $50 security deposit.
If cleaning costs exceed $50, the Customer must pay the remaining balance.
4. Deep cleaning may be required for gum, marker, paint, candle wax, oils, or other residue.
5. Items left outdoors overnight and damaged by weather or moisture may result in a full replacement charge.
6. All items must be ready for pickup at the scheduled time.

PART 6 — WEATHER & CANCELLATION POLICY (FINAL)
1. Florida weather can be unpredictable. The Customer must plan a covered or safe area for equipment in case of rain or wind.
2. The $50 security deposit is non-refundable if the Customer cancels for any reason.
3. If weather prevents setup or delivery, the Customer receives one (1) free reschedule to a new available date.
4. The rescheduled date must be used within 90 days of the original event date.
5. After the free reschedule, any additional date change may require a new deposit.
6. No refunds are given for unused time or early pickup due to weather.
7. If the Provider determines that weather conditions could cause equipment damage or safety risk, the Provider may delay, reschedule, or cancel delivery for equipment protection.
8. The Customer must keep the original receipt or booking confirmation as proof of the weather-affected date in order to receive the reschedule credit.

PART 7 — CUSTOMER RESPONSIBILITIES (FINAL)
1. The Customer is responsible for the safe and proper use of all rental equipment.
2. All machines and equipment must be operated by adults only.
3. Children are not permitted to operate or handle machines such as hot dog rollers, snow cone machines, popcorn machines, cotton candy machines, or any electrical/rental equipment.
4. The Customer is responsible for supervising all children around the equipment at all times.
5. SMITH PARTY BEE is not liable whatsoever for injuries, accidents, or harm caused by improper use, lack of supervision, or children operating the equipment.
6. If insurance coverage is used in the future, liability will only apply to equipment malfunction, not customer misuse.
7. The Customer agrees to use all rental items in a safe location, away from water, heat hazards, or unsafe conditions.

PART 8 — AGREEMENT, LEGAL NOTICE & SIGNATURE

By signing below, the Customer confirms that:

They have read and agree to all rental terms and policies

They understand the $50 deposit is a security deposit, not a payment toward the rental
They accept responsibility for all equipment while in their possession
They understand that misuse or lack of supervision voids liability
They agree to pay any remaining balance for damages or replacement if costs exceed the deposit
